Terms and Conditions
These are the general terms and conditions of www.hundelieb.com – hereinafter also referred to as “Hundelieb”, “Website” or “We”. Persons who use the services of hundelieb.com are hereinafter referred to as “User”, “Member”, “You”, as well as “Dog Owner” or “Dog Lover” (which describe the two types of membership).
1. Conclusion of Contract
1.1 The use of the free services of Hundelieb requires registration. Unless otherwise explicitly stated, the services of Hundelieb are free of charge. Reading and accepting these terms and conditions as well as the privacy policy is a prerequisite for using our offer. If you place an order in our shop, the Terms and Conditions for the Shop also apply. If you participate in our partner program, the terms and conditions of the partner program also apply. The minimum age for using our offer is 18 years.
1.2 During the registration process, personal data is requested, which is required for the creation of the user account and the fulfillment of our services. This may include the following data: full name, email, address, telephone number, date of birth. Subsequently, a profile as a dog owner or dog lover can be created, which requires further (partly mandatory, partly voluntary) information from the user. This may include: interests, character traits, experiences, description, gender, information about the dog, availability. The data is stored in internal databases.
1.3 If a user decides to use paid services, they will be informed about services, prices, and payment conditions before concluding. By clicking on a “Pay” (or similar) button, the contract is concluded. An invoice is issued exclusively in electronic form and is available in the user account..
2. Scope of Services
2.1 Hundelieb offers an online platform where dog owners and so-called dog lovers (persons who like to spend time with a dog but do not want to own one themselves) can meet.
2.2 Services such as creating a profile and responding to inquiries are free of charge. After creating a profile, users are only offered the option of a paid upgrade, which unlocks additional features. This can only happen through the activity and provision of payment details by the member. There is no automatic transition from a free to a paid membership.
2.3 By registering, a contractual relationship between the customer and Hundelieb is established. This also includes creating a profile as a dog owner and/or dog lover. After creating the profile, it is automatically visible to other users. A free membership also allows the use of various website/application functions, such as search functions to find other dog owners or lovers, managing interesting profiles and settings, and responding to inquiries from other members. However, to specifically contact other members and not just respond to inquiries, a paid profile is required.
3. Obligations of the Customer
3.1 The user is not entitled to grant third parties access to their member account or to transfer their member account to others. It is the user's responsibility to choose a secure password for access to the user account, keep it confidential, and take further precautions to prevent third parties from gaining access to their account. Furthermore, each customer is prohibited from opening multiple member accounts. The customer undertakes to inform Hundelieb immediately about any unauthorized access to their account.
3.2 The user undertakes to provide truthful information regarding their account.
3.3 The user assures that their content used on the website/application, texts, images, videos, audios, and other materials, whether published or not, do not contain any legal violations and allows Hundelieb to distribute them free of charge, worldwide on the website/application or for offers related to the website/application, such as Hundelieb social media profiles.
3.4 The user undertakes that neither they nor (to their knowledge) members of their household have been convicted of a crime that endangers the safety of others. This includes crimes such as theft, robbery, extortion, bodily harm, sexual abuse, and deprivation of liberty. Furthermore, the customer undertakes to indemnify Hundelieb from any claims, demands, and damages of any kind that may arise from their participation in this service.
3.5 The user assures that they will use the service of Hundelieb exclusively for private, non-commercial purposes.
3.6 User data may not be manually or automatically read and/or used outside the service of Hundelieb. The user undertakes to treat the data of other users confidentially and not to pass it on to third parties.
3.7 The user undertakes not to misuse the service. This includes: pornographic, right-wing extremist, glorifying violence, illegal or obscene content; insults, harassment or violation of the personal rights of other members; sending commercial messages or chain letters or such messages containing infected software.
3.8 Free users undertake not to disclose any contact details in their profile unless explicitly required. Active contact initiation is reserved for premium members.
3.9 Failure to comply with these obligations or suspicion thereof may lead to a request for a statement, restrictions in the use of the service, deactivation or deletion of the member account, compensation payments, and, if necessary, criminal consequences.
3.10 The user undertakes to inform themselves about legal regulations and to comply with them.
4. Due Date, Renewal, Termination
4.1 A free membership is unlimited in time and does not require termination. If a user wishes to request the deletion of their data, they can do so independently (see contact form) or request it through our contact form.
4.2 A paid membership can be purchased for different durations (e.g. monthly, semi-annual, annual). The respective price is shown on the payment page.
4.3 The contract is automatically extended by one year each time, unless the customer terminates it via the website/application or in writing. The right to prevent the contract renewal by termination exists from the conclusion of the contract until no later than two weeks before the end of the contract via our contact form. Termination is possible via the app settings or the login area of the website/application until one day before the end of the contract.
5. Liability of Hundelieb
5.1 Hundelieb does not guarantee that a contact mediation will be established during the contract period but merely provides a platform for exchange and contact possibilities.
5.2 Hundelieb assumes no liability for the content and any false information in registration, profile, or other data created by users. Hundelieb is also not liable for content created by others or taken from external sites, which may appear in guest posts on the blog, comments, or discussion forums. Furthermore, Hundelieb cannot be held responsible if users or third parties misuse the service despite prohibition or gain unauthorized access to data (e.g., “hacker attacks”).
5.3 Hundelieb is not liable in any way for damages of any kind caused by members. This also includes property damage and personal injury caused by a (borrowed) dog. Hundelieb therefore recommends taking out independent insurance.
5.4 The contents of this website/application are created with the utmost care. However, no liability is assumed for the accuracy, completeness, and timeliness.
5.5 This website/application contains links to third-party websites. External sites are checked for possible legal violations when linked. However, Hundelieb has no influence on possible changes to the content of these sites and can therefore not guarantee the accuracy of these sites. If we become aware of a legal violation, Hundelieb undertakes to remove the link immediately.
5.6 Hundelieb guarantees an availability of 95% on an annual average, with downtime due to internal maintenance, updates, and technical issues on the part of the website/application already included. If availability falls below this value, a reasonable partial refund of the annual fee can be requested. Unavailability due to technical problems on the part of the user (e.g., due to the use of outdated technologies or incorrect settings) or third parties (e.g., server maintenance) are not included.
6. Rights of Hundelieb
6.1 Hundelieb reserves the right to deactivate or delete profiles, comments, articles, memberships, or user accounts, or exclude users from certain activities (e.g., participation in the discussion forum) without giving reasons. Furthermore, user-generated texts or images can be changed or deleted at any time if there is suspicion of illegality or if they are deemed inappropriate. Fees already paid will not be refunded in these cases.
6.2 The user grants Hundelieb a free, non-exclusive, worldwide right to use, publish, reproduce, modify, and distribute the content, including images, that the user provides on the website/application. The user ensures that the published content does not violate any laws.
6.3 Hundelieb is entitled to commission third parties to provide services, provided this does not disadvantage the customer, and to pass on the user's data to third parties for the purpose of providing these services.
6.4 The content and works provided on this website/application are subject to Austrian copyright law. Reproduction or further processing is not permitted without express permission.
6.5 In the event of violations of the terms and conditions, Hundelieb may demand compensation or reimbursement of expenses in the amount of the proven damage.
7. Right of Withdrawal
7.1 The user has the right to withdraw from this contract within 14 days from
the conclusion of the contract without giving any reason.
To exercise your right of withdrawal, please cancel your membership in the
customer area of the website/application or contact us via our contact form.
7.2 The customer has no right of withdrawal for contracts for services that begin to be performed for the consumer from the conclusion of the contract. The customer expressly agrees that the aforementioned right of withdrawal lapses with this.
8. General Provisions
8.1 These terms and conditions, as well as all texts on the website/application, apply to both female and male persons, even if, for the sake of simplicity, terms such as "the user" and "the dog lover" are used.
8.2 Austrian law applies.
8.3 Should parts of these terms and conditions be invalid or the contract incomplete, the validity of the remaining content remains unaffected.
8.4 Updates to these terms and conditions can be made here at any time and replace the previous version. It is recommended to read these provisions each time you visit the website/application to ensure they continue to meet your approval. If you do not agree to these terms and conditions, you are obliged to stop using the website/application's services and cancel your membership.
